ACCEPTABLE USE POLICY

It is important to us that our customers use our services and the Internet in general, responsibly and courteously. Most of our customers do so and seldom need to refer to these AUPs. Nonetheless, the following constitute examples of unacceptable uses of Radical Networks’s services, which will result in suspension, or termination of the customer’s account.

AFFRONTS TO ETIQUETTE

Unacceptable activities include spamming (sending unsolicited advertising to those with which the customer has no existing business relationship, posting off - topic advertising in (newsgroups); spoofing (using a return email address which is not the valid reply address of the sender or sending an email message which does not contain enough information to enable the recipient to identify the party who is really sending the message; passive spamming (promoting a web site hosted by Radical Networks by spamming from some other source), trolling (posting controversial messages in newsgroups to generate responses), mail bombing (inundating a user with email without any serious intent to correspond), and subscribing someone else to an electronic mailing list without that person's permission.

ACCOUNT OWNERSHIP

Radical Networks is only responsible to the present owner of the Web hosting space. We verify ownership by credit card number (if paid for by credit card), name, address, email address, username, & password. If you give this information to any other party or give access to your email address on your account to another party, you risk having your Web site and any other information on your account changed and/or deleted. We are not responsible for any information on your account should you reveal this information to another party who causes damage to your account and/or Web site.

BACKUPS

Full backups are made weekly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content and any information on their account including but not limited to clients website, email, databases, mailing lists, and archives. If data loss occurs due to negligence of client in securing their account or by an action of the client, Radical Networks will not be responsible.

PAYMENT POLICIES AND FEES

Full payment is required before any hosting service is rendered, which includes renewals. All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or fax. Prepayment is due each anniversary (one month, or one year) following the date the account was established. Additional features can be added at any time.

RESELLERS

You must follow our steps to becoming a reseller. For more information go to our Resellers Page. You provide billing to your customers. We do not bill your customers. We bill you for the domain name and space, then you in turn bill them for your cost from us and your services in addition to that. Actual or attempted violations of policy by a customer's end user shall be considered violations of the policy by the customer regardless of intention and will be acted upon accordingly. Your customers are given a limited amount of transfer and if we feel that one of your customers are using up more transfer than allocated or are taking up too much of the CPU usage then we will need to pass some of the extra cost on to you and you will need to pass it on to your customer. You will need to put that in your terms and conditions for the hosting. You agree that neither you nor your customers can hold us responsible for services that you offer. Your customers have to abide by the same terms and conditions as you do, or we have the right to cancel any of your reseller accounts. If you abuse our services, we reserve the right to cancel your account, which will also cancel your customers accounts. We reserve the right to remove the link to a reseller's Web site on our Web Design page if it has been determined that the reseller is affiliated in any way with a competitor of Radical Networks, if it has been determined that the reseller is not representing Radical Networks professionally or appropriately, or if it has been determined that the reseller has violated our Acceptable Use Policy.

ABUSE OF THE LEGAL RIGHTS OF OTHERS

Examples of unacceptable activities in this regard include posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code which will have a deleterious effect on third party computers. Radical Networks supports free speech on the Internet, and will not suspend or cancel a customer’s account simply because it disagrees with the views expressed by the customer. Where there are allegations that a customer’s on-line activity has violated the legal rights of a third party, Radical Networks will not substitute itself for a court of law in deciding tort claims raised by the third party.

ABUSE OF LAW

Radical Networks’s services may be used for lawful purposes only. Illegality includes but is not limited to drug dealing, attempting without authorization to access a computer system, pirating ( distributing copyrighted material in violation of copyright law ), gambling, schemes to defraud, trafficking in obscene material, violating U.S. / INDIAN export restrictions, stalking, or violating other state or federal law such as the Electronic Communications Privacy Act, the Computer Fraud and Abuse Act, or the Economic Espionage Act.

Indemnification Policy

In no event shall Radical Networks be liable for any kind of loss including loss of profits, loss of data, injury to person or property or any other kind of damage caused to the customer. The Customer agrees totally defend, indemnify, save and hold Radical Networks harmless from any and all demands, liabilities, losses, costs and claims against Radical Networks

PORNOGRAPHY

Pornography and sex-related merchandising, even if legal, is not an acceptable use of Radical Networks’s servers.

ABUSE OF RADICAL NETWORK'S SERVER RESOURCES

Running programs in the background on a Radical Networks’s server without Radical Networks’s prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, Spamming, and the like are not acceptable uses of Radical Networks’s servers. Radical Networks shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Radical Networks reserves the right to terminate an account at any time and for any reason that causes harm to other Radical Networks customers. Limitation of Liability. Radical Networks shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Radical Networks’s servers going off - line or being unavailable for any reason whatsoever. Further, Radical Networks shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Radical Networks’s servers. All damages shall be limited to the immediate termination of service.
